- Tenant and buyer's full legal names
- Home address and legal description
- Rental start date
- Option period (years)
- Monthly rent ($)
- Part of each month's rent credited to the price ($)
- Option fee paid at signing ($)
- Purchase price ($)
- If rent is paid late, what happens to that month's credit?
- Who pays for repairs?
Good to know
- In Ontario the rental part is still a tenancy under the Residential Tenancies Act: also sign the government Standard Lease (our free Ontario Standard Lease helper) and attach this as additional terms.
- Ask your lawyer to register a notice of option on title, so the owner can't sell or mortgage the home to someone else.
- Check the owner really owns the home and is up to date on the mortgage: a title search costs little. Pay the option fee to a lawyer in trust, never in cash.
