Good to know
- Register title as tenants in common with each share written on the transfer (in Ontario, on the electronic transfer by your lawyer). Joint tenants pass their share to the survivors, which may not be what you want.
- Each owner should make a will that deals with their share, and consider life insurance so the others can buy it out.
- In Ontario, the Partition Act lets a co-owner ask a court to sell the property, but courts usually respect a signed agreement not to do so for a set time.
Help in your language
Every question comes with help like this. For example, “Does any of these apply to you?”:
English: These raise extra legal or tax issues (for example family law rights to a matrimonial home, or non-resident tax rules). We still build your agreement.
Français: Ces situations soulèvent d'autres questions juridiques ou fiscales. Nous préparons quand même votre entente.
