What you will fill in
- Does any of these apply?
- Employer's legal name and address
- Employee's full name
- Date the employee started
- Last day of employment
- Employee's regular weekly pay ($)
- Is your total Ontario payroll $2.5 million or more a year?
- Weeks of working notice already given
- Extra amount you offer in exchange for the release ($)
- Benefits during the notice period
- Will you give a reference letter?
- Days the employee has to decide
Good to know
- ESA termination pay and severance pay must be paid whether or not the employee signs. Pay it by the later of 7 days after the last day or the next pay day.
- Issue the Record of Employment (ROE) to Service Canada within 5 calendar days after the interruption of earnings (or by the pay-period rule).
- Courts often award more 'common law' notice than the ESA minimum. That is why the extra amount and release matter.
