Good to know
- A big change to job, pay or hours without the employee's agreement can be a constructive dismissal. Get a signed acceptance, and give a real benefit such as a raise.
- Under Ontario's ESA, managers and supervisors whose work is mainly managerial are not owed overtime pay. If the promotion removes overtime, say so plainly.
- Do not reduce service or seniority. The employee keeps their original start date for notice and vacation.
