Good to know
- Ontario's Employment Standards Act, 2000 does not require termination notice in the first 3 months. After 3 months of work, notice or pay instead of notice is owed, even if the contract calls it probation.
- A probation period only exists if the signed contract says so. Without a written clause, courts usually give reasonable notice from day one.
- If you want to extend probation instead, the employee must agree in writing, and ESA notice rules still apply after 3 months.
