What you will fill in
- Who is giving the guarantee?
- Guarantor: full name and address
- Whose debt is guaranteed?
- Who receives the guarantee?
- What is guaranteed?
- Maximum amount guaranteed ($)
- Does it cover future debts too (continuing guarantee)?
- Which province's laws apply?
- Date of this guarantee
Good to know
- Alberta: a personal guarantee by an individual has no effect unless the guarantor appears before a lawyer and the lawyer signs the certificate required by the Guarantees Acknowledgment Act. It does not apply to a corporate guarantee.
- Ask for a dollar limit and an end date. Ask to be released when the borrower's debt is paid down.
- Never sign a guarantee you do not understand. You can be sued for the whole debt without the lender first suing the borrower.
