Good to know
- Securities: in Ontario, paying finders for bringing in investors can require registration as a dealer under the Securities Act and National Instrument 31-103, and fees paid in an exempt offering are reported to the Ontario Securities Commission.
- Real estate: under the Trust in Real Estate Services Act, 2002 only a registered brokerage may be paid for trading in real estate, so an unregistered finder cannot share a commission (RECO). Mortgages need an FSRA licence; insurance needs an insurance licence.
- Tell referred customers that the finder is paid a fee. Hidden payments can mislead customers and can be a crime if the finder is someone's employee or agent (Criminal Code s. 426, secret commissions).
